Terms and Conditions of Use for Next Generation File Submission Test Site

  1. Please read these Terms and Conditions of Use that govern the use of this Next Generation File Submission Test Site (“Test Site”), as well as PIDM’s Privacy Notice as set out at https://www.pidm.gov.my/privacy-notice (“Privacy Notice”) carefully before you use this Test Site. By accessing any part of the Test Site, you shall be deemed to agree to be bound by these Terms and Conditions of Use and the Privacy Notice.
  2. Whenever used in these Terms and Conditions of Use, the following words and terms shall have the meanings set out below:
    • “MI” means a member institution as defined in the PIDM Act;
    • “PDPA” means the Personal Data Protection Act 2010, as amended from time to time;
    • “Personal Data” shall have the same meaning as defined in the PDPA;
    • “PIDM”, “us”, “we” or “our” means Perbadanan Insurans Deposit Malaysia;
    • “PIDM Act” means the Malaysia Deposit Insurance Corporation Act 2011, which includes all subsidiary legislation made pursuant to the PIDM Act, as may be amended from time to time;
    • “Terms and Conditions of Use” mean these terms and conditions of use for the Test Site; and
    • “User”, “you” or “your” means any person nominated by an MI to access or use the Test Site.
  3. IMPORTANT: The MI or the User –
    1. must generate a test file which contains only dummy data and does not contain any Personal Data (“Test File”), to be used for purposes of testing in the Test Site;
    2. must use the Test Site only for purposes of testing the encryption and decryption of the Test File in the manner as informed by PIDM or for any other purposes as specifically instructed by PIDM; and
    3. must not upload any real data or Personal Data to the Test Site.
  4. Access to and use of the Test Site is at the User’s sole risk. To the fullest extent permitted by law, PIDM provides the Test Site on an “as is” basis, makes no representations or warranties of any kind, whether express, implied, or statutory, and shall not be liable for any loss or damage, including any consequential effects, arising from or in connection with the User’s access or use of the Test Site.
  5. Unless otherwise stated and save for third-party open-source components, all materials contained in the Test Site, including design, text and images as well as any software programmes or contents available on the Test Site are protected by copyright, trademark or other proprietary rights owned by PIDM. No part of the Test Site owned by PIDM may be reproduced, stored or included in any other platform or any public or private electronic retrieval system or services without prior written permission from PIDM. In addition to these Terms and Conditions of Use, the third-party open-source components are subject to the relevant third party licences, and shall not be used unless expressly permitted by the applicable third-party open-source licences.
  6. The browser and network requirements to access the Test Site are as follows:
    1. Browser: The Test Site is supported on the latest major versions of Google Chrome (currently version 145) and Microsoft Edge (currently version 145) or higher. User must ensure their browsers are fully updated prior to accessing the Test Site.
    2. Network: Access to the Test Site is restricted to the corporate network IP address(es) registered by the MI and that are whitelisted for the current standard file format submission (“SFF Submission”). Users must access the Test Site exclusively from the registered IP address(es).
  7. The User must ensure that the device(s) used to access and use the Test Site and any documents, information or other materials uploaded or submitted by the User to the Test Site, including the Test File (“User’s Contents”) are secure and free from malicious viruses or any other potential threats that can harm the Test Site or other Users.
  8. The User is responsible for – (a) maintaining the confidentiality of the login ID and password used to access and use the Test Site; (b) ensuring no one else gains access to the User’s account; and (c) all activities that occur under the User’s account. PIDM is under no obligation to verify the actual identity or authority of any user of a login ID and password and will not be liable for any damages and expenses arising out of or relating to any unauthorised use of such login ID or password.
  9. The MI and the User – (a) warrant that it has the necessary rights and authority to upload the User’s Contents to the Test Site for the required purposes; (b) shall remain solely responsible for the User’s Contents submitted to PIDM; (c) warrant that the User’s Contents and PIDM’s access to the User’s Contents will not infringe or otherwise violate any intellectual property rights, trade secret or any other rights of any third party; and (d) acknowledge that PIDM has the right but not the obligation to pre-screen, monitor, review, edit or delete any User’s Contents submitted. PIDM takes no responsibility and assumes no liability for any User’s Contents submitted by the MI or the User. The MI or the User agrees to indemnify PIDM for all claims resulting from or relating to any User’s Contents the MI or the User submitted.
  10. The MI and the User agree at all times to observe and comply with the provisions of the PDPA in respect of any Personal Data.
  11. The MI and the User agree to defend, indemnify and hold PIDM, its directors, employees and representatives harmless from and against all loss, actions, claims, damages, costs and expenses, including but not limited to legal fees and disbursements on a full indemnity basis, arising or related to the MI’s or the User’s unlawful use of the Test Site or any breach of these Terms and Conditions of Use.
